OVERVIEW
Welcome to Ashley Eckhoff Fitness. The terms "we," "us," and "our"
refer to Ashley Eckhoff Fitness. Ashley Eckhoff Fitness operates
this website and provides an online, subscription-based digital
fitness platform, including on-demand workout videos, live classes,
training programs, and related content and services (the "Services").
These Terms of Service ("Terms") describe your rights and
responsibilities when you use the Services. Please read these Terms
carefully, as they include important information about your legal
rights and cover areas such as billing, warranty disclaimers, and
limitations of liability.
By visiting, interacting with, or using our Services, you agree to
be bound by these Terms and our Privacy Policy [LINK]. If you do
not agree to these Terms or our Privacy Policy, you should not use
or access our Services.
SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms, you represent that you are at least
18 years of age (or the age of majority in your jurisdiction) and
have the legal capacity to enter into a binding agreement.
To access the Services, you may be required to create an account
and provide information including your name, email address, and
payment information. You represent and warrant that all information
you provide is accurate, current, and complete, and that you have
the right to provide it.
You are solely responsible for maintaining the security of your
account credentials and for all activity that occurs under your
account. You may not share, transfer, sell, or assign your account

SECTION 2 - THE SERVICES
Ashley Eckhoff Fitness provides digital fitness content, including
pre-recorded on-demand workout videos, live-streamed classes,
structured training programs, and related digital materials. The
Services are provided for personal, non-commercial use only.
You acknowledge that the Services are not a substitute for medical
advice, diagnosis, or treatment. You should consult with a qualified
healthcare professional before beginning any new exercise program,
particularly if you have any pre-existing medical conditions, are
pregnant, or have concerns about your physical health. By using the
Services, you assume all risks associated with physical exercise,
including but not limited to injury.
We reserve the right to modify, add, or discontinue any Services
or content at any time without notice.
SECTION 3 - MEMBERSHIPS AND BILLING
Access to certain Services requires a paid membership or the purchase
of a package. Memberships automatically renew on a recurring basis
(monthly, unless otherwise specified) at the price in effect at the
time of renewal.
By purchasing a membership, you authorize us to charge your payment
method on a recurring basis until you cancel. You may cancel at any
time through your account dashboard. Cancellation will stop future
billing but does not entitle you to a refund for the current billing

Prices are subject to change. We will provide notice of any material
price changes before they take effect. Continued use of the Services
after a price change constitutes acceptance of the new price.
You agree to keep your payment information accurate and up to date.
If a payment fails, we may suspend your access to the Services until
payment is received.
SECTION 4 - INTELLECTUAL PROPERTY
All content available through the Services, including but not limited
to videos, images, text, graphics, training programs, class
descriptions, trademarks, and the Ashley Eckhoff Fitness name and
logo, is owned by Ashley Eckhoff Fitness or its licensors and is
protected by U.S. and international copyright, trademark, and other
intellectual property laws.
These Terms grant you a limited, non-exclusive, non-transferable,
revocable license to access and use the Services for your personal,
non-commercial use only. You may not:
- Reproduce, distribute, modify, or create derivative works of any
content from the Services
- Publicly display, publicly perform, or republish any content
- Download, record, or transmit any content (except as expressly
permitted by the Services)
- Use the Services or any content for commercial purposes, including
teaching classes or reselling access
- Share your account credentials with others
- Use automated tools, scrapers, bots, or AI agents to access or
extract content
Unauthorized use of the Services or content may result in
termination of your account and legal action.
SECTION 5 - PRIVACY
Your use of the Services is governed by our Privacy Policy [LINK],
which describes how we collect, use, and share your personal
information. By using the Services, you acknowledge that you have
read and understand our Privacy Policy.
Because the Services are hosted on Shopify and delivered through
Recess (our third-party fitness platform provider), your information
may be shared with these providers as necessary to deliver the
Services. Please review their privacy policies for more information
on their data practices.
SECTION 6 - THIRD-PARTY LINKS AND SERVICES
The Services may include links to third-party websites or services
that are not owned or controlled by Ashley Eckhoff Fitness. We are
not responsible for the content, privacy practices, or terms of use
of any third-party services. Your interactions with third parties
are solely between you and the third party.
SECTION 7 - USER-GENERATED CONTENT AND FEEDBACK
If you submit reviews, testimonials, comments, or any other content
to the Services ("User Content"), you grant Ashley Eckhoff Fitness
a perpetual, worldwide, royalty-free, sublicensable license to use,
reproduce, modify, publish, and display such User Content for any
purpose, including marketing and promotional use.
You represent and warrant that any User Content you submit is your
own original work, does not infringe any third-party rights, and
does not violate any applicable law. We reserve the right to remove
any User Content at our discretion.
We are not obligated to review or monitor User Content, but we may
do so at our discretion.
SECTION 8 - PROHIBITED USES
You may not use the Services:
- For any unlawful purpose or in violation of any applicable law
- To infringe on our intellectual property rights or those of others
- To harass, abuse, or harm any person
- To impersonate any person or entity
- To transmit viruses, malware, or malicious code
- To use automated tools, scrapers, bots, AI agents, or other
automated means to access the Services
- To reproduce, duplicate, copy, resell, or exploit any portion of
the Services
- To share, distribute, or record any content from the Services
outside of your personal use
- To circumvent any security or authentication measures
We reserve the right to suspend or terminate your account at any
time, without notice, if we determine you have violated these Terms.
SECTION 9 - TERMINATION
We may suspend or terminate your access to the Services at any time,
without notice, for any reason, including if you violate these Terms.
Upon termination, your right to access the Services ends immediately,
and any remaining paid period on your membership is forfeited.
You may cancel your membership at any time through your account
dashboard. Sections related to Intellectual Property, User-Generated
Content, Disclaimer of Warranties, Limitation of Liability,
Indemnification, and Governing Law will survive termination.
SECTION 10 - DISCLAIMER OF WARRANTIES
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT
WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT
NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR
A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED,
ERROR-FREE, OR SECURE. WE MAKE NO GUARANTEES REGARDING THE FITNESS
OR HEALTH OUTCOMES YOU MAY EXPERIENCE FROM USING THE SERVICES.
INDIVIDUAL RESULTS MAY VARY.
SECTION 11 - LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, ASHLEY ECKHOFF FITNESS, ITS
OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE
FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE
DAMAGES ARISING FROM YOUR USE OF THE SERVICES, INCLUDING BUT NOT
LIMITED TO PERSONAL INJURY, LOST PROFITS, LOST DATA, OR LOSS OF USE.
YOU EXPRESSLY ACKNOWLEDGE THAT EXERCISE CARRIES INHERENT RISKS OF
INJURY. BY USING THE SERVICES, YOU ASSUME ALL SUCH RISKS AND RELEASE
ASHLEY ECKHOFF FITNESS FROM ANY LIABILITY ARISING FROM PHYSICAL
INJURY YOU MAY SUSTAIN.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID
US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
SECTION 12 - INDEMNIFICATION
You agree to indemnify and hold Ashley Eckhoff Fitness harmless
from any claims, damages, liabilities, or expenses (including
reasonable attorneys' fees) arising from your breach of these Terms,
your violation of any law or third-party rights, or your use of the
Services.
SECTION 13 - GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by the laws of the state where Ashley
Eckhoff Fitness is headquartered, without regard to conflict of law
principles. Any disputes arising from these Terms or your use of
the Services shall be resolved in the state or federal courts of
that jurisdiction.
SECTION 14 - CHANGES TO THESE TERMS
We may update these Terms at any time. Material changes will be
communicated through the Services or by email. Your continued use
of the Services after changes are posted constitutes your acceptance
of the updated Terms.
SECTION 15 - MISCELLANEOUS
If any provision of these Terms is found to be unenforceable, the
remaining provisions will remain in full force and effect. Our
failure to enforce any right or provision does not constitute a
waiver of that right or provision. You may not assign these Terms
without our written consent. These Terms constitute the entire
agreement between you and Ashley Eckhoff Fitness regarding the
Services.
